Terms and conditions

1. General provisions

  1. These terms and conditions set out the rules for the use of the online platform Eventy CarSwag, hereinafter referred to as the "Platform".
  2. The Platform is owned by KSolutions Kacper Smółkowski, with its registered office at al. Stanów Zjednoczonych 32/241, 04-036 Warsaw, registered under the NIP number 7743174132, hereinafter referred to as the "Administrator".
  3. Use of the Platform is tantamount to acceptance of these terms and conditions.

2. Definitions

  1. Platform, App - a web-based Eventy CarSwag platform for registering for automotive Events and purchasing Tickets.
  2. Company, Application Administrator - KSolutions Kacper Smółkowski, owner of the Platform.
  3. Administration - the operation and development team of the Platform.
  4. User - a person using the Platform to register their participation in an Event or purchase a Ticket.
  5. Organiser - the person or entity organising the Events, using the Platform to manage entries and/or sell Tickets.
  6. Event - an event for which Users can register and/or purchase Tickets via the Platform.
  7. Entry - the process of registering the User's participation in an Event, also called "application".
  8. Entry Chat - the Platform's communication tool enabling contact between the User and the Organiser in the context of an Entry.
  9. Vehicle - the vehicle submitted by the User on the Platform in order to participate in Events.
  10. Ticket - an electronic document entitling the holder to attend an Event, purchased via the Platform.
  11. Buyer - the person purchasing a Ticket to an Event.
  12. Commission - the fee charged by the Administrator to the Organiser for the sale of Tickets on the Platform.
  13. Payment Operator - a third-party company that processes payments for Tickets.

3. Rules of Event Entries

  1. Registration on the Platform is free of charge and requires the provision of basic personal data.
  2. The user can add their Vehicles, their data and photos for the
  3. The User can enter the Event by selecting one of the added Vehicles for Entry.
  4. The Organiser shall only receive the details of the User and his/her vehicle once the User has created an Entry for the relevant Organiser Event.
  5. The Organiser may accept or reject the User Entry.
  6. Within the Platform, communication between the User and the Organiser takes place via the Entry Chat.

4. Rules of Tickets sales

  1. The Platform mediates the sale of Tickets for an Event between the Organiser and the Buyer on behalf of the Organiser.
  2. Tickets can be purchased through Payment Operators, which are third-party companies.
  3. No registration is required to purchase Tickets.
  4. The purchase of a Ticket is equivalent to acceptance of the Platform Rules, the Privacy Policy and the Rules of the relevant Event.
  5. After purchase, Tickets are sent to the email address provided. For registered Users, Tickets are also available in the User Panel.
  6. When purchasing a Ticket, the Buyer's details are provided to the Organiser for the purpose of operating the Event.
  7. The Organiser is responsible for handling returns and invoicing for the Event.
  8. If an Event is cancelled or postponed, the Organiser must notify the Platform Administrator.
  9. In the event of cancellation of the Event, the refund to the Buyers remains with the Organiser. The Organiser remains liable to pay the Commission for the Tickets sold.
  10. The Platform takes a commission from the Organiser as agreed between the Organiser and the Platform Administrator.
  11. Upon completion of the Event, the Platform will issue a VAT invoice to the Organiser for the services provided, within 7 working days. The fee for the Commission will be deducted from the funds raised from the sale of Tickets.

5. Obligations of the Organiser

  1. The organiser is obliged to correctly and reliably enter information about the Event, including description, date, venue and conditions of participation.
  2. The Organiser is fully responsible for the execution of the Event for which Tickets are sold or Entries are accepted via the Platform.
  3. The organiser is obliged to comply with the applicable laws on the organisation of events and the processing of the Buyers' personal data.
  4. In the event of cancellation or postponement of an Event, the Organiser must notify the Platform Administrator as soon as possible.
  5. The organiser is obliged to ensure that participants can be contacted about the Event and to resolve any problems or complaints.
  6. In the event of cancellation of the Event, the Organiser is responsible for refunding the Buyers.
  7. The Organiser remains liable to pay commission for all Tickets sold, even if the Event is cancelled.
  8. The Organiser undertakes to comply with the commission arrangements and the terms and conditions of use of the Platform, in accordance with the terms and conditions and the agreement concluded with the Platform Administrator.
  9. The Organiser may not use the Platform for illegal activities or in a way that violates the Platform's rules and regulations.
  10. The Organiser shall be held fully responsible for any breaches of the Rules and Regulations and consequences arising from its activities on the Platform.

6. Obligations and rights of the User

  1. The User is obliged to provide truthful data when registering and using the Platform.
  2. You are responsible for all actions taken under your account.
  3. Sharing your account with third parties is prohibited.
  4. The user should take care of the security of their login data.
  5. Use of the Platform must be in accordance with applicable law and the Terms and Conditions.
  6. The user may not publish content that is unlawful, offensive or infringes on the rights of others.
  7. When participating in an Event, the User agrees to abide by its rules and regulations.
  8. The User accepts that their data may be transferred to the Organiser for the purpose of operating the Event.
  9. Any technical problems should be reported to the Platform Administrator.
  10. The User may unsubscribe from the Platform at any time, but this does not relieve them of any obligations arising from previous activities on the Platform.
  11. You have the right to access and correct your personal data. They may also object to the processing of their data and request data portability. Any requests for data processing can be made to eventy [monkey] carswag.co.uk.
  12. You may request the deletion of your account and personal data by sending an email stating "Deletion of account/data" to eventy [at] carswag.co.uk. The request will be processed within 14 working days. If the User has previously applied for Events or purchased tickets, the data of their Entries will be anonymised.

7. Protection of personal data

  1. The administrator of Users' personal data on the side of the Platform is KSolutions Kacper Smółkowski with its registered office at al Stanów Zjednoczonych 32/241, 04-036 Warsaw, NIP: 7743174132.
  2. Users' personal data are processed in accordance with applicable legislation, including Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR/RODO).
  3. The Administration applies technical and organisational measures to ensure the protection of the personal data processed, including encryption of communication (SSL/TLS), control of access to systems and security monitoring.
  4. The Organiser is the separate controller of the personal data provided to it as part of the operation of the Event and is fully responsible for its processing.
  5. For detailed information regarding the processing of personal data, including purposes, legal basis and Users' rights, please refer to the Privacy Policy available at https://eventy.carswag.pl/page/privacy-policy .
  6. Use of the Website constitutes acceptance of the provisions of the Privacy Policy.
  7. You have the right to access, rectify, erase or restrict the processing of your personal data, as well as to lodge a complaint with a supervisory authority.
  8. The Administration shall provide appropriate technical and organisational measures to protect the data against unauthorised access.

8. Notification and Communication

  1. An active e-mail account is required to use the Platform.
  2. The platform can send notifications and messages via email, SMS, Push notifications and notifications in the App.
  3. The Platform sends required messages that are necessary for the proper functioning of the Platform. All other messages are sent on the basis of the User's consent.
  4. Messages concerning the User Account
    The platform sends account-related emails such as:
    • Account activation (confirmation of email address)
    • Password reset (forgotten password)
  5. Notification-related messages
    You will receive notifications regarding your Submission, including:
    • Change in the status of the Entry
    • Notification Chat messages from the Organiser
  6. Messages to Organisers
    The organiser receives notifications of:
    • New messages in the Chat Notifications from the User
    • New entries
  7. Messages relating to Orders, Tickets
    The platform also sends messages related to purchased Tickets and other information needed to process the transaction, including:
    • Change in order status
    • Change in payment status
    • Confirmation of Ticket purchase
    • Electronic tickets
  8. Marketing messages relating to the Platform
    The Platform may send marketing messages and notifications related to Events on the Platform if the User consents. Consent is voluntary and can be withdrawn at any time.
  9. Third party marketing messages
    The Platform may send marketing messages to third parties if the User has consented to this. Consent is voluntary and can be withdrawn at any time.

9. Accountability

  1. The Administrator is not responsible for the actions of Users and Organisers.
  2. The administrator reserves the right to block a user's account in the event of a breach of the terms and conditions.

10. Final provisions

  1. The administrator reserves the right to amend these regulations.
  2. Any changes to the terms and conditions will be communicated to users in good time.
  3. In matters not covered by these rules, the provisions of Polish law shall apply.
